How overtime pay works in the US

Under the federal Fair Labor Standards Act (FLSA), most hourly (non-exempt) employees must be paid at least 1.5 times their regular rate โ€” "time and a half" โ€” for hours worked beyond 40 in a single workweek. This calculator works out overtime and total pay from your rate and hours.

Worked example

At $20 an hour working 46 hours in a week: 40 regular hours ร— $20 = $800, plus 6 overtime hours ร— $30 (1.5 ร— $20) = $180, for $980 total. The overtime premium applies only to the hours above 40.

Who qualifies

Overtime rules cover non-exempt workers. Salaried employees in certain executive, administrative or professional roles who meet duties and salary tests are "exempt" and generally are not entitled to overtime. Whether a role is exempt depends on its actual duties and pay, not just its job title.

State rules can add more

The federal rule is a floor, and some states are more generous. California, for example, requires daily overtime after 8 hours in a day and double time beyond 12, on top of the weekly rule. Always check your stateโ€™s law, since the higher standard applies.
